Terms of Use
1. Parties and acceptance
These terms apply between EROVİYA E-TİCARET LİMİTED ŞİRKETİ ("Eroviya", "we") and the person who installs, creates an account in or uses the Eroviya Touch app (the "App", "you"). By installing the App or creating an account you accept these terms and the Privacy Policy. If you do not accept them, do not use the App.
2. Age requirement: 18+
The App works with products intended for adults. You may install and use the App only if you are at least 18 years old and legally allowed to use such products where you live. We close accounts we learn belong to people under 18. Using the App with, or letting it be used by, anyone under 18 is strictly prohibited.
3. Account
- An account requires a valid e-mail address, a display name and a password. The display name may be a nickname; you may not impersonate someone else.
- The account is personal; do not share your password. You are responsible for activity under your account.
- If you notice that your password or account has been compromised, write to hello@eroviya.com immediately.
- You can have your account deleted at any time: Delete your account.
4. Description of the service
The App lets you control Eroviya devices that respond to Bluetooth Low Energy broadcasts and, optionally, link with another user for a consent-based remote control session. The sale, warranty and return of devices are governed by the eroviya.com store's terms; these terms cover only the App. The App is currently free; if paid features are added, they will be announced in advance and require your separate consent.
5. Consent and remote control rules
Remote control is used between two adults and only with explicit, informed consent that can be withdrawn at any moment. The App supports this as follows, and you agree to comply:
- A session starts only when the receiver accepts the control request. The receiver decides which device is used and the maximum level (the cap).
- The receiver can press STOP, end the session, unlink or block the other party at any time. If the connection drops, the device stops on its own.
- You comply immediately when your partner says stop, sends a reaction or ends the session; trying to get around this (opening another account, applying pressure) is a breach of these terms.
- Non-consensual use, harassment, threats and anything involving minors lead to immediate account closure and, where appropriate, a report to the authorities. You can report to us using Report in the App.
6. Prohibited uses
- Interfering with the device or account of a person who has not consented; using the App to drive someone else's device without their knowledge,
- Creating fake accounts, impersonating others, misusing invite codes,
- Modifying the App or abusing the service through reverse engineering in a way that harms the server or other users, sending automated requests, attempting to bypass security measures,
- Using the App for any purpose that is unlawful where you are.
Examining the App for your own device and your own use is fine; the line above is harming others.
7. Intellectual property
The App, its design, logos and content belong to Eroviya; you receive only a personal, non-transferable, non-exclusive right to use it. The mixes and patterns you create in the App are yours.
8. Device safety and health notice
- Use your device according to the manufacturer's instructions. Stop immediately if you feel discomfort, pain or irritation. Consult a physician before use in case of pregnancy, a pacemaker, skin conditions or similar. The App is not a medical product and does not give medical advice.
- The Bluetooth LE broadcast has no device-side authentication or encryption; a compatible device within range could receive commands. Use the device in a trusted environment and switch it off when you are done.
- Motion pages (Shake, Tilt, Draw) use the phone's sensors; mind your surroundings and do not drop the phone.
9. Limitation of liability
The App is provided "as is". We do not guarantee uninterrupted or error-free operation or compatibility with every phone and device. To the extent permitted by applicable law, Eroviya is not liable for indirect damage arising from use of or inability to use the App; this clause does not limit your rights under consumer protection law. Our liability for devices is limited to the terms of sale and warranty.
10. Suspension and termination
If you breach these terms we may suspend or close your account without prior notice; serious breaches (non-consensual use, minors) lead to permanent closure. You may have your account deleted at any time. On termination, your personal data is deleted within the periods in the Privacy Policy.
11. Changes
We may update these terms. Significant changes are announced in the App and on this page at least 15 days in advance; continuing to use the App after the change means you accept the new terms.
12. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Antalya have jurisdiction over disputes; your rights as a consumer to apply to consumer arbitration committees and to the courts of your place of residence remain reserved.
